Terms of Service

1. Acceptance of terms
By creating an account or using the Ark platform, you agree to these Terms of Service. If you are using Ark on behalf of a business, you represent that you have the authority to bind that business to these terms. If you do not agree, do not use Ark.
2. The service
Ark provides gym management software including an AI coaching assistant for members, an admin dashboard, and associated tools. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.
3. Accounts and access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@novark.app of any unauthorised use.
You may not share your account credentials with third parties or use Ark to serve businesses other than your own without a white-label agreement.
4. Subscription and billing
Ark is offered on a seat-based subscription model. Subscriptions are billed monthly or annually in advance. Seats are calculated based on your active member count.
Your 90-day free trial begins on the date of account creation. No credit card is required during the trial. At the end of the trial, access is suspended until a plan is activated.
Refunds are available within 7 days of any billing cycle if you contact us and have not made substantial use of the platform in that period.
5. Acceptable use
You agree not to use Ark to:
- Upload or transmit illegal, harmful, or misleading content
- Violate any applicable law or regulation
- Attempt to reverse engineer, decompile, or extract the source code of Ark
- Resell or sublicense access to Ark without written permission
- Use automated tools to scrape or extract data from the platform
- Overload the platform infrastructure through abusive request patterns
6. Your content and data
You retain ownership of all content you upload to Ark — diet plans, workout programs, member information, and business data. By uploading content, you grant Ark a limited licence to store and process that content solely for the purpose of providing the service to you.
You are responsible for ensuring you have the right to upload any member data and that doing so complies with applicable privacy laws in your jurisdiction.
7. AI features
The AI coaching and assistant features are powered by large language models (currently Groq / OpenAI). The AI is designed to assist, not replace, qualified fitness professionals. Ark does not guarantee the accuracy of AI-generated advice.
You are responsible for reviewing AI outputs before acting on them and for ensuring your members understand they are interacting with an AI system.
8. Intellectual property
The Ark platform, brand, and underlying technology are owned by Ark and protected by applicable intellectual property laws. Nothing in these terms grants you any rights to the Ark name, logo, or software beyond what is necessary to use the service.
9. Limitation of liability
To the maximum extent permitted by law, Ark's liability for any claim arising from use of the platform is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost revenue, lost data, or business interruption.
10. Termination
You may cancel your account at any time from the billing settings. We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation. On termination, your data is retained for 90 days before deletion.
11. Governing law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
